Who should file TDS Returns?
Persons making payment of Specified nature are required to deduct Tax at Source (TDS) or collect Tax at source (TCS) and remit the same to the Government. Such persons (Deductors) need to obtain TAN (Tax Collection Account Number) and electronically file TDS returns quarterly showing details of Payment, tax deducted, Deductees, etc in accordance with Section 206 of Income Tax Act, 1961. Such electronic filing of returns is compulsory and should be done on a timely basis failing which interest, late fees and penalties shall be charged.
Late Fees, Interest & penalties
- Late fees in addition to interest in delay of deposit, shall be charged on late filing of returns. Late fees of Rs. 200 shall be charged per day from the due date of return filing till the date such return has been filed.
- Interest on delay of deposit of TDS: TDS should be deposited by the 7th of the month following the month in which the TDS was deducted. Any delay will attract interests. When TDS not deducted either fully or partly , interest of 1 % per month from date on which Tax should have been deducted till date of deduction.When TDS deducted but not deposited either fully or partly, interest of 1.5% per month from date of deduction till date of deposit.
- Penalty: The Assessing Officer may direct payment of penalty in addition to late fees and interest. A minimum penalty of Rs. 10000 may be charged which may extend to Rs. 100000
TDS Returns Due Dates
TDS returns shall be filed on a Quarterly basis, except for Tax deducted on specific payments such as payment of rent or payment for purchase of property (sale consideration above 50 lakhs) where the return should be filed within 30 days from the last day of the month in which tax was deducted.
Also Note, that the due date for payment of TDS is the 7th of the following month.
